- When contacted directly via our websites or via our customer services department to request information about our services.
- By purchasing a product or a service directly from us.
- When permitted contact details are transferred from one of our Accounts/Services team.

In order for us to provide you Maintenance, Fabrication, Tank Testing or Meter Calibration Service. KC Commercials need to collect personal data Maintenance service due or Test cert expiries, etc.
Our reason (lawful reason) for processing your data under the GDPR is:
2.1 Where we are required to perform a contract
We may use and process personal data where it is necessary for the performance of a contract for the following purposes:
a) entering a contract for On-site Service.
b) entering a contract for the maintenance of a motor vehicle.
c) to exchange information for accounts/billing.
d) to allow for the provision of third-party breakdown services by our service provider.
2.2 Where required to comply with Legal Obligations
We may use personal data to comply with our legal obligations in, (a) assisting a Garda Síochána, or any other public authority or statutory authority for the purposes of criminal or other related investigations, (b) to enable legitimate identification in complying with our legal obligations, and (c) to verify the accuracy of the data that we hold.

We may use and process personal data where it is necessary for us to pursue our legitimate interests as a business, and where our reasons for using it outweigh any prejudice to data protection rights, as follows:

We may pass your personal data on to third-party service providers contracted to KC Commercials while dealing with you. Any third parties that we may share your data with are obliged to keep your details securely, and to use them only to fulfil the service they provide on your behalf. When they no longer need your data to fulfil this service, they will dispose of the details in line with KC Commercials procedures.

We have issued all our third-party processors with a Data Processor checklist asking them GDPR specific questions.
If we transfer personal data to a third party or outside the EU, we as the data controller will ensure the recipient (processor or another controller) has provided the appropriate safeguards and on condition that enforceable data subject rights and effective legal remedies for you the data subject are available.

KC Commercials facilitate you, our clients, rights in line with our data protection policy and the subject access request procedure. This is available on request.
